General

These terms apply between FENIXSTORE.SE and the online store's user ("The Customer ”) when the Customer buys products via the fenixstore.se online store on the website fenixstore.se. By purchasing products in the online store, the Customer accepts these conditions and undertakes to comply with them.

FENIXSTORE.SE reserves the right to change these conditions by announcing the changes in the online store. The customer accepts the terms and conditions applicable at any time when shopping in the online store.

In addition to these terms, the online store also applies Fenix Nordic's general terms and conditions for web services.

Ordering

Products are ordered in the online store by putting them in the shopping cart and paying for them at the online store's checkout. The customer is asked to check the contents of the shopping cart before completing the order. A binding, payable order arises when the customer sends their order in the online store. An order confirmation and current purchase conditions are then sent automatically to the customer's email address when the order has been received. fenixstore.se has the right for a justified reason to refuse an order or parts of it even after the order confirmation has been sent.

30 days right of cancellation and free return

Private customers have the right of cancellation within 30 days from receipt of the product. Before returning, customer service must be contacted and returns must be made with Posten MyPack return. The product must be returned in original packaging, as well as in undamaged and resalable new condition. In the event of damage or missing components, we reserve the right to reduce the value or not accept the return.

We check all goods before we send them out, but should the goods be damaged or otherwise defective or if you have received wrong product or wrong quantity, please contact us immediately (within 7 days) by email or phone so that we can correct the error. We will replace the faulty item at no cost to you as soon as possible.

If you want to return or exchange a product, please contact us via e-mail: kundservice@fenixstore.se.

We will give you instructions for the return and send you the necessary MyPack waybill. The return is free. Please attach the following information:

  • Reason for return (e.g. damage, unwanted, wrong product)
  • Name and order number

NOTE ! Refusing to collect your shipment is not a valid right of withdrawal. Read more under unreleased shipment.

Delivery time

Orders where all products are in stock, received before 2 p.m. are usually dispatched the same day, next weekday at the latest. If the product is not in stock or the delivery time deviates from what is stated on the website, we will contact you immediately. Normal delivery time for stocked products is 3-4 working days. Order confirmation is sent via e-mail and to the address given at the time of the order.

Please note that our delivery times may be longer than usual during busy seasons such as Black Friday, Cyber Monday, Christmas, and other seasonal sales. However, we strive to process orders as quickly as possible and will keep you informed about the status of your order.

If one or more products are not in stock, we will wait to send the entire order until all products are back in stock. Order confirmation is sent via e-mail and to the address given at the time of the order.

These general terms and conditions (“the terms”) apply when you as a consumer (“the customer”) place an order via the website. The terms and conditions are only applicable to customers who are consumers and who place orders via the Website.

As stated above, an agreement is concluded when purchasing via the website between you and fenixstore.se.

In order to order on the website, the customer must be 18 years of age. According to Swedish law, the seller does not accept credit purchases for persons under the age of 18. The seller reserves the right in individual cases to refuse or change a customer's order (for example if the customer has provided incorrect personal data and/or has payment complaints).

The seller reserves the right for final sales and any image and writing errors on the website, for example errors in the product description or technical specification, incorrect prices and price adjustments (such as changed prices from suppliers, currency changes) or incorrect information regarding whether an item is in stock. The seller has the right to correct any such errors and to change or update the information at any time. All image information on the website should be viewed exclusively as illustrations. Such illustrations cannot be guaranteed to represent the number of items the customer receives or the item's exact appearance, functions or origin.

The website is owned by fenixstore.se. The content on the website is owned by fenixstore.se or its partners or its licensors. The information is protected by, among other things, intellectual property and market laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without written approval from fenixstore.se.

Shipping cost

• PostNord MyPack: starts at 79 SEK (check the final price at checkout as it may depend on the delivery address).
The package can be collected from your local Posten's MyPack agent. You will receive an SMS when the package is ready for collection.

• PostNord MyPack Home Delivery: starts at 154 SEK (check the final price at checkout as it may vary depending on the delivery address).
Within Sweden, we deliver the recipient's package during the day on weekdays, the recipient can receive their home delivery no earlier than the following weekday after a time window has been selected. There are usually several time windows to choose from and vary depending on the recipient's address. Home delivery is also offered in all major Swedish cities in the evening.

• PostNord Parcel Advance: starts at 250 SEK (check the final price at checkout as it may vary depending on the delivery address).
The package is delivered to the addressee during office hours. The service includes a delivery. The storage time for the shipment after a delivery attempt is the week when the shipment arrives and the following week.

The prices

All prices include VAT and all payments are charged in SEK.

The prices are stated excluding shipping and other possible handling and additional costs, these are stated separately in the online store's checkout before the order is approved. The same breakdown is also shown on the order confirmation sent to the Customer.

Payment

The Customer can pay for his order in the online store via the payment options specified for the Customer. The payment options are determined according to the contents of the Customer's shopping cart. Payments are processed by our payment partner Stripe. You can pay for your order via credit card, Klarna, or direct payment via bank.

Stripe is a safe and simple payment method. When you pay for your order by credit card directly in fenixstore.se, the payment services are provided by Stripe. Your payment is processed directly on the Payments page, which means that you are not redirected to an external payment service. When you pay for your order with Stripe, you agree to Stripe's terms and conditions, which you can read here.

Credit card: Visa, MasterCard, American Express

In connection with the payment, it is also possible to use any benefit codes offered by fenixstore.se to the Customer, which may give the right to a product- or order-specific discount or free shipping.

Access

fenixstore.se strives to always have correct and up-to-date information about the products in the online store but cannot guarantee the correctness of the information and that the products are available. Products presented in the online store may also be out of stock at the moment or sold out.

It may happen that the availability of a product displayed in the online store and in the shopping cart changes before or after payment. fenixstore.se contacts the Customer if, after receiving the order, it appears that fenixstore.se is temporarily or unable to deliver the ordered goods. If the order cannot be delivered at all, and the Customer does not accept a replacement product, fenixstore.se will refund the entire order amount to the Customer.

Cancellation

The customer can cancel their order, if the order is not delivered within a reasonable time. Cancellation must always be made in writing to kundservice@fenixstore.se. We aim to contact the customer by e-mail if the delivery time deviates from normal delivery times. fenixstore.se reserves the right to cancel the order and return the money to the customer.

Complaint

All complaints against orders or delivery, please be sent in writing within (7) days after you receive the delivery to: kundservice@fenixstore.se.

Warranty

The warranty period varies between different products, as specified in the product information. The warranty period starts from the date on the receipt. In case of warranty claims, the product, essentially only the component suspected to be defective, is sent to us for examination. It is typically repaired or replaced with a completely new one if the warranty is justified. We cover the return shipping for warranty cases within Sweden only. Customers outside Sweden are responsible for all shipping and related expenses. Keep the receipt safe as it is required for claims.

The warranty covers defects in workmanship and materials. The warranty does not cover product misuse, customer-modified products, installation errors, any damages caused e.g. by leaked batteries etc., neglect of instructions, or damage to products caused by other faulty actions. The warranty covers defective components, associated labor, and shipping costs within Sweden only. The warranty does not cover any potential reinstallation costs for the replaced part covered by the warranty. A product warranty replacement does not extend the original warranty period of the product.

Data protection

FENIXSTORE.SE collects the information about its customers and the online store's users, in order to offer its customers the best possible service experience. The customer data is used i.a. to deliver a safe service and to develop the online store and customer service quality.

FENIXSTORE.SE respects the privacy of customers, and uses the collected personal data only for the purposes described in our data protection description. FENIXSTORE.SE neither sells nor passes on the customer data in other contexts than described in the seventh point of the description.

The customer must agree to the terms of the data protection description (read terms and conditions) in order to use fenixstore.se's service.

The warranty covers the product and any shipping. Replacement of the product does not extend the original warranty period.

Liability for property damage caused by the goods

The buyer shall indemnify the seller to the extent that the seller is held liable to third parties for such damage or loss , for which the seller is not liable towards the customer according to the second and third paragraphs of this clause.

The seller is not liable for damage caused by the goods
a) to real or movable property if the damage occurs when the goods are in the buyer's possession possession, or
b) on products produced by the buyer or on products in which the buyer's products are included, or for damage to real or movable property caused by these products due to the goods.

The seller is not responsible in any case for loss of production, loss of profit or other consequential economic loss.

Said limitations on the seller's liability do not apply if he has been guilty of gross negligence.

If a third party makes a claim against the seller or the buyer for compensation for damage or loss referred to in this point, the other party must be immediately notified of this.

Force majeure

FENIXSTORE.SE waives all responsibility for delivery delays or other breaches of contract which is due to an insurmountable obstacle (force majeure).

Applicable legislation and competent court

The law of Finland is applied to these conditions, except for its choice of law provisions, unless otherwise required by mandatory legislation in the Customer's place of residence.

The parties to the contract shall primarily endeavor to resolve any disputes relating to these terms or their application through negotiation. Disputes that cannot be resolved through negotiation between the contracting parties shall be resolved at the Helsinki District Court in Finland. However, the customer always has the right to refer the dispute resolution to a court in their place of residence or another body that deals with consumer disputes. In Finland, the Consumer Disputes Board is such a body. Before the customer goes to court or any other body that deals with consumer disputes, it is recommended that the customer first contact the consumer advisory service in their own country.

The customer also has the option of having a dispute regarding purchases via the web tried through alternative dispute resolution outside the general court via The European Commission's web-based ODR forum for dispute resolution (ODR = Online Dispute Resolution).
